  • This law requires employers to provide nursing breaks of a prescribed length for new mothers to express breast milk for the nursing child. These nursing breaks are fully paid and are available until the child reaches 15 months of age.
  • This Maternity Benefits Act was amended in 2017, whereby every establishment with fifty or more employees must provide the nursery facility at a distance as offered separately or with common facilities was added. A worker will be entitled to four visits to the crèche per day.

According to the Nursery Guidelines issued by the Ministry of Women and Child Development, Government of India;

  1. A crèche should be provided for 30 children aged 6 months to 6 years of all types of employees.

  3. Employers are required to employ one crèche attendant and one assistant for 10 children under 3 and for 20 children aged 3 to 6.

Apart from this, different states like Maharashtra, Uttar Pradesh, Rajasthan and Tamil Nadu in the country have established various laws to alleviate maternity assistance in the states. However, these laws may vary from state to state, but have the following points in common:

  • The construction, maintenance and sanitation of crèches must be ensured.
  • Nurseries should have sanitary facilities and be located at suitable distances from the place of work.
  • Adequate supply of milk for each child per day.
  • Provide reasonable and adequate breastfeeding breaks to nursing mothers.

Although various measures are being taken to provide relief to breastfeeding mothers, some states still do not have specific breastfeeding laws and policies. The increase in the number of working women and the importance of breastfeeding require stricter maternity policies and quality childcare services to enable female employees in all sectors to achieve positive health outcomes. breastfeeding.
